System Development Fee Analysis & Public Comment
In June 2017 the North Carolina General Assembly ratified House Bill 436 “An Act to Provide for Uniform Authority to Implement System Development Fees for Public Water and Sewer Systems in North Carolina and to clarify the Applicable Statute of Limitations”, thus amending Chapter 162A of the General Statutes by adding “Article 8, System Development Fees.” As a requirement of the aforementioned amended statute, the Town of Gibsonville retained the services of Alley, Williams, Carmen & King, Inc., a professional engineering consulting firm, to complete a System Development Fee Analysis and prepare an accompanying written report. This report is an update to the previous report from 2018 and incorporates the Town’s Water and Sewer Master Plan from 2020.
Prior to considering adoption of a System Development Fee, the amended statute stipulates the local governmental unit must post the written analysis on its webpage or otherwise make it available for public review and comment. This public review and comment period shall extend for a minimum of 45 days and afford a means for written comments to be submitted to the analysis preparer.
